Terms

the terms you buy on. written to be read, not to be survived. nothing here removes a right you have under uk consumer law, and if anything on this page ever conflicts with that law, the law wins.

Who you are buying from

this store trades as Sluggers Hit in the united kingdom. the registered company details are in the notice at the top of this page and must be filled in before the store opens.

How a contract is formed

placing an order is an offer to buy. it is not yet a contract, and the confirmation screen and confirmation email are not an acceptance of it — they confirm we received your order and nothing more.

the contract comes into existence when we dispatch the goods, and it covers only the goods actually dispatched. this matters when something in your basket turns out to be unavailable: we are not obliged to sell you something we do not have, and you are not charged for it.

if we cannot accept your order we will tell you and refund anything you have paid. the usual reasons are stock, an obvious pricing error, or an address we do not deliver to.

Prices

every price on this site is in pounds sterling and includes uk vat at 20%. the price you see on a product page is the price you pay for that item. there is no charge added later except delivery, which is shown and chosen before you confirm.

delivery starts at £4.95 and the options are set out on the delivery page.

the price that applies is the one displayed when you place your order. a later price change, in either direction, does not alter an order already placed.

if a price is obviously wrong — wrong by an order of magnitude, the kind of error nobody could reasonably read as a real offer — we may refuse the order rather than fulfil it. we will tell you and refund you in full. we will not use this to wriggle out of a sale we simply regret.

Stock

availability shown on a product page is our best current figure and is not a guarantee. two people can want the last one at the same moment. if that happens after you order, we will tell you and refund that line.

Your account of yourself

you need to be at least 18, or have a parent or guardian make the purchase, and the delivery address you give us needs to be one you can actually receive a parcel at. an address we cannot deliver to is the most common reason an order goes wrong.

Cancelling and returning

your right to cancel and your rights when something is faulty are on the returns page. they are part of these terms.

What we are responsible for

if we fail to meet these terms we are responsible for loss you suffer that is a foreseeable result of that failure. we are not responsible for loss that was not foreseeable, and we are not responsible for business losses — this is a shop for consumers.

nothing here limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit. that includes your statutory rights over the goods themselves.

Things outside anyone control

where something genuinely beyond our control delays us, we will tell you and we will not be liable for the delay itself. if it goes on long enough to matter, you can cancel and be refunded in full for anything undelivered.

The brand and this site

the sluggers hit name, the logo, the marks and the photography on this site belong to their owners and are not yours to use. buying a jersey buys you the jersey.

Changes

we can change these terms, but the terms that govern your order are the ones in force when you placed it. a change does not reach backwards.

Governing law

these terms are governed by the law of england and wales, and the courts of england and wales have jurisdiction. if you live in scotland or northern ireland you may also bring proceedings in your own courts.

you always have the option of taking a complaint to the relevant consumer body. we would rather you told us first and gave us the chance to fix it.
